1. Who we are

These terms apply to bookings made directly on ilviandantesail.com. The service is provided by Ditta Individuale Balla Gabriella, trading as Il Viandante Sail, VAT no. IT03070730993, Via Punte Rosse 39/b, 07024 La Maddalena (SS), Italy.

In these terms, “we” means the business above and “you” means the person making the booking, who confirms that they also book on behalf of the other guests in their group.

2. What we offer

Small group day trip: a sailing and snorkeling day trip in the La Maddalena archipelago on a shared boat, with a maximum of 10 guests. The price is per person.
Private charter: the whole boat for your group, up to 10 guests. The price is the price for whole boat, whatever the number of guests in your group max 10.

3. Booking and payment

A booking is confirmed when you receive our confirmation email. Prices are in euros and include [VAT/IVA, if applicable]. To book, you pay a 50% deposit online. The balance is paid. If we do not receive the payment on time, we may cancel the booking.

4. Cancellation by you

Free cancellation up to 24 hours before departure: the deposit is refunded.
If you do not show up at the meeting point, no refund is due.
To cancel, write to ilviandante222@gmail.com or message us on WhatsApp. You may transfer your booking to another person by letting us know in advance.For consumers: under Italian consumer law, the right of withdrawal does not apply to leisure services for a specific date or period, so the conditions above are the ones that apply.

5. Weather, safety and changes by us

The skipper decides whether and where to sail, based on forecasts, sea state and safety. We check the forecast one or two days before and contact you if the trip is at risk.

If we cannot sail because of bad weather or safety reasons, we offer another date or a full refund.
The route and stops may change on the day for the same reasons. This is not a reason for a refund if the trip takes place.
We may cancel a trip for reasons beyond our control. In that case we offer another date or a full refund.
If you cannot join on the new date, you may choose a full refund.

6. Guests, health and safety

Tell us at booking about allergies, intolerances, health conditions, pregnancy, mobility limits and swimming ability, so we can plan safely.
Guests must follow the safety briefing and the skipper’s instructions, and the rules of the La Maddalena National Park. Do not touch, collect or take anything from the sea.
Snorkeling is surface snorkeling only, without diving tanks, and you take part at your own pace. Children and weak swimmers use the equipment we provide and stay under adult supervision.
We may refuse boarding or end the trip for guests who are not fit to sail, who are under the influence of alcohol or drugs, or who put themselves or others at risk. No refund is due in these cases.

7. Food and drinks

Lunch is prepared on board. Please tell us about allergies and diets when you book: Gabriella contacts every guest after booking. We take great care but cannot guarantee a kitchen free of traces of allergens. Wine and beer are served with lunch only. We do not serve alcohol to minors or to guests who have had enough.

8. Liability and insurance

The boat and the activity are covered by insurance as required by law. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be limited by law. We are not liable for loss or damage to personal items on board, or for damage caused by guests. Guests are responsible for damage they cause to the boat or equipment.

9. Bookings through other platforms

If you booked through another platform (for example GetYourGuide), the terms and cancellation policy of that platform apply to your booking, together with the practical rules of the trip in sections 5, 6 and 7.

10. Photos and videos

We may take photos and videos during the trip. We publish images in which you can be recognised on our website or social media only with your agreement. Tell us before departure or at any time if you do not want to appear in them. See our Privacy Policy for details.

11. Complaints

Please tell us about any problem during the trip so we can solve it on the spot. After the trip, write to ilviandante222@gmail.com within [14] days. We reply within [30] days.

12. Privacy

We process your personal data as described in our Privacy Policy.

13. Governing law

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim before the competent court of your place of residence or domicile.

14. Changes

We may update these terms. The version that applies is the one in force on the date of your booking.
